The revision petition is against complaining of conduct of a Judge who had not given sufficient opportunities to the defendant, closed his evidence and granted the decree. The appropriate remedy will be to prefer an appeal and urge amongst other grounds, the inadequacy of opportunity given to the defendant and the mis-trial as one of the grounds that had culminated in the decree being granted. The appropriate remedy will be by means of appeal and not by means of revision petition.

The revision petition is dismissed with liberty to approach the Appellate Court and state the objection taken now as the objection in grounds of appeal.
