Petitioner has prayed for direction to the Civil Judge (Jr. Division), Patiala to decide applications under Order 7 Rule 11 and Order 39 Rule 1 & 2 in accordance with law within fixed time frame. It has been urged before the court that various applications have been adjourned for no rhyme or reason. Due to this, the matter is getting delayed. Thus, necessary directions be issued to the civil court.
A query has been put to learned counsel for the petitioner that for seeking this innocuous direction why this voluminous petition running into more than 370 pages have been filed, no clear answer is forthcoming. Besides, suit was instituted in the year 2015. Thereafter, various applications are being moved before the civil court by the parties. The case does not call for interference in revision jurisdiction. It is not possible for this court to opine on the basis of record whether the proceedings are being delayed, if so, at whose behest. The court finds this petition wholly frivolous. Same is dismissed with `20,000/- as costs.
