Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.197 dated 25.12.2019 registered under Section 408 of Indian Penal Code, 1860 at Police Station City Nawanshahr (Annexure P-1). While granting interim protection to the petitioner on 31.01.2020, this Court passed the following order:- "It is stated that no inquiry in the matter had been conducted before dispensing with services of the petitioner. As a matter of fact the petitioner was a whistle-blower, who had pointed out the misappropriation of funds by Kulbir Singh, Accountant. In the letter written by Deputy Registrar, Cooperative Societies, Shaheed Bhagat Singh Nagar to Additional Registrar, Cooperative Societies, Nawanshahar dated 31.3.2014, it has been SAVITA KADIAN 2021.09.01 16:19 I attest to the accuracy and integrity of this document High Court Chandigarh

CRM-M-2212 of 2020 {2} observed that the dues were to be recovered from Kulbir Singh, Accountant. The present petitioner has nothing to do with the said scam and he is ready and willing to join the investigation. Notice of motion for 31.3.2020.

The petitioner is directed to join the investigation by contacting the Investigating Officer within five days from today and render all sort of cooperation. The petitioner is to surrender his passport before the Investigating Officer, if he has got one, otherwise to furnish affidavit in that regard. If in the meanwhile, he is arrested, he be released on bail to the satisfaction of the Investigating Officer/Arresting Officer." Learned State counsel, on instructions from ASI Jaswinder Singh submits that the petitioner has joined investigation and is no longer required for custodial interrogation. He has further instructions to state that the petitioner is not involved in any other criminal case. In view of the above facts, but without commenting on the merits of the case, the present petition is allowed and the order dated 31.01.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure.
