Learned counsel for the petitioner seeks to withdraw the present petition with liberty to amend his plaint to include therein the prayer of seeking to be declared owner of Rattan Singh/Malkiat Singh's property and then pray for stay.

Dismissed as withdrawn with liberty as prayed for. It is made clear that this Court has not expressed any opinion on the right of the petitioner to seek amendment of his plaint or thereafter to seek an interim order. Such applications for amendment and stay, if made by the petitioner, would be considered by the Trial Court on its merits and dealt with in accordance with law.
