There is no merit in the revision petition and the defendant cannot be allowed to have water over the plaintiff's land if there is no sanctioned water course. At least the plaintiff had prima facie case to contend that the channel of water was being sought to be taken over his land even when there was no sanctioned water course. The trial Court had dismissed the injunction application and the Appellate Court in my view correctly reversed the decision and allowed for the order of injunction.

There is no scope for intervention. The revision petition is dismissed.
