**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. This is a petition under Articles 226/227 of the Constitution of India for issuance of directions to respondents No. 2 to 5 to take legal action against respondents No. 6 and 7 and also to protect his life and liberty from hands of respondents No. 6 and 7.
Learned counsel for the petitioner submits that the land measuring 28 kanals and 16 marlas is in the name of the society i.e. Mukari Co-operative Regulation and Soil conservation Society Limited, Mukari and the said land was reserved for forest area and is Jumla Mustarka Mallkan. He further submits that the private respondents have been doing illegal mining in the said land and committed the theft of soil upto 8 feet. He has also placed on record the photographs as Annexure P-2. Learned counsel for the petitioner further submits that in this regard, the petitioner has moved a representation dated 07.12.2020 against the private respondents. Thereafter, the private respondents started extending threats to the petitioner and GURPREET SINGH 2021.01.25 16:42 I attest to the accuracy and integrity of this document Chadigarh
CRWP No. 701 of 2021 -2regarding this, he has moved a representation dated 11.1.2021 (Annexure P-5) to Senior Superintendent of Police, Rupnagar-respondent No. 3 but no action has been taken on the same so far.
Notice of motion to respondents No. 1 to 5 only at this stage. On the asking of the Court, Randhir Singh Thind, DAG, Punjab, accepts notice on behalf of the State-respondents No. 1 to 5. I have heard the learned counsel for the parties. Keeping in view the above, Senior Superintendent of Police, Rupnagar-respondent No. 3 is directed to look into the representation dated 11.1.2021 (Annexure P-5) moved by the petitioner and decide the same within a month from the receipt of certified copy of this order, as per law. The petition stands disposed of.
