Sito Kaur and others ........Respondents

Present:

Mr. Suresh Singla, Advocate for the petitioners.

CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.

Whether Reporters of local papers may be allowed to see the judgment ?

2.

To be referred to the Reporters or not ?

3.

Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.

There is literally no explanation offered as to why the petitioner must be summoning the register containing the Will from the Registrar's office. A provision is possible under the Indian Evidence Act making possible for a person to secure a certified copy of a document that can be obtained by person who is entitled to the same particularly if he is himself beneficiary or person claiming under a beneficiary. The petitioner will adopt such a course and move a fresh application along with the alleged first page of the original Will which is said to be in his custody. If the petition is filed with the necessary documents and explanation given for loss of original, the Court will take the document and allow for cross-examination of the party tendering the document with the certified copy in accordance with law.

2.

The revision petition is disposed of with the above observations.
