Petitioner has filed this petition under Section 482 Cr.P.C. against State of Punjab and other respondents for issuance of appropriate order or direction to the official respondents No.2 and 3 to investigate case FIR No.117 dated 18.10.2018 under Sections 304, 342, 148 and 149 IPC, registered at Police Station City Fazilka, as per law and to take appropriate action against the accused persons by arresting and to present the challan. Notice of motion was issued. Learned State counsel as well as respondent No.4-in person appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. CRM No.M-2262 of 2019 -2At the time of arguments, it has been brought to the notice of this Court that after investigation, challan has already been presented against two accused and two more have already been declared proclaimed offenders. One more accused has been arrested and challan is going to be presented against him in the near future also. As investigation is complete and challan has been presented against two accused and further, two accused have been declared proclaimed offender and one more accused has been arrested, against whom supplementary challan is going to be presented, in these circumstances, I find that the main relief sought in the petition has become infructuous and no further action is required in the matter. Nothing has been argued regarding threat to life and liberty of the petitioner and other family members.
