Learned counsel for the appellant submits that by the impugned order dated 20.12.2023 passed by learned Single Judge, in CWP No. 28721 of 2023 the impression has been given by the learned Single Judge that the compensation paid to the private respondents is just and proper keeping in view their respective share whereas, the same was yet to be determined, keeping in view the liberty given by the learned Single Judge recorded in the last paragraph No. 4 of the impugned order dated 20.12.2023 that in case any reference is moved by the appellant, the Land Acquisition Collector will decide the same in accordance with law.

Learned counsel for the respondents-State submits that in case, any reference is filed by the appellant before the authorities concerned, the same will be considered and an appropriate speaking order will be passed by the authority concerned.

Learned counsel for the respondents-State further submits that in RIYA 2026.02.24 15:59 I attest to the accuracy and integrity of this document

LPA-1098-2024 (O&M) case, the notice issued by the DRO (Anneuxre P-4) dated 15.12.2021 is still pending consideration before the authorities concerned, the same will be considered and an appropriate speaking order will be passed by the authority concerned. Otherwise, the appellant is requested to file another application for the consideration of the same, and in case, any such application is filed by the appellant, the same will be considered and an appropriate order will be passed by the authorities concerned within a period of eight weeks. 4.

Learned counsel for the appellant submits that keeping in view the statement of learned State counsel, the present appeal may kindly be disposed of having been not pressed any further with liberty to file an application, as stated herein before.
