The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No. 96, dated 25.06.2016 registered under Sections 323, 452, 148, 149 and 325 of the Indian Penal Code, 1860 at Police Station Rahon, District SBS Nagar.

At the time of issuance of interim directions the following order was passed on 20.1.2020:

- 2 - "The petitioner has filed this petition under Section 438 of the Code of Criminal Procedure, 1973 (for short 'the Cr.P.C.') for grant of anticipatory bail in case FIR No.96 dated 25.06.2016 registered under Sections 323, 452, 148, 149 and 325 of the Indian Penal Code, 1860 at Police Station Rahon, District SBS Nagar.

Learned Counsel for the petitioner has submitted that on investigation by the police, the petitioner was found to be innocent and was kept in column No.2. The petitioner was summoned under Section 319 of the Cr.P.C. Co-accused Ramji Dass, Davinder Kumar and Satpal have compromised with the complainant and petition for quashing of FIR on the basis of compromise is pending. The petitioner is ready to join the investigation.

Notice of motion.

On the asking of the Court, Mr. Arun Kaundal, DAG, Punjab accepts notice on behalf of the respondent-State. Copy of the paper book has been supplied to the learned State Counsel, who seeks time to complete his instructions. Adjourned to 24.03.2020.

In the meanwhile, the petitioner is directed to join the investigation as and when called upon to do so. In the event of his arrest, the petitioner shall be released on interim bail by the arresting officer/investigating officer on furnishing of bail bonds by him to the satisfaction of the arresting officer/investigating officer. The petitioner shall comply with the conditions enumerated under Section 438(2) of the Cr.P.C. failing which he shall not be entitled to the protection of interim bail allowed to him."

It has been informed by learned State counsel that pursuant to interim order passed by this Court, the petitioner had appeared before the trial Court and that supplementary challan already stands presented against the petitioner.

In view of the aforestated position wherein the petitioner who had been summoned with the aid of Section 319 Cr.P.C. has already appeared before the trial Court and supplementary challan stands filed, the petition is accepted and the interim directions issued by this Court vide order dated 20.1.2020 are hereby made absolute subject to the condition that the petitioner shall regularly appear before the trial Court.
