Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.156 dated 06.10.2018 under Section 15 of the NDPS Act, registered at Police Station Bhogpur, District Jalandhar Rural.

I have heard learned counsel for the petitioner and have gone through the record.

As per the FIR, five bags of poppy husk from car, nine bags of poppy husk from truck and one bag of poppy husk each weighing 20 kgs. were recovered. All the vehicles were going together and the petitioner was apprehended from the car. The recovery in the present case falls under commercial quantity. Section 37 of the NDPS Act bars the grant of bail to the accused in the case of commercial quantity.
