Rajan Gupta, J (Oral) Present revision is directed against the order passed by District Judge, Family Court-1, Faridabad whereby maintenance of Rs.7000/- per month has been granted to the respondent-wife by filing application under Section 125 Cr.P.C.

It appears that petitioner and respondent got married on 3.7.2010. Out of wedlock, one son was born on 14.8.2011. Respondent alleged that petitioner started harassing her for bringing less dowry and was subjected to cruelty. She filed instant application seeking maintenance. It was contended that respondent was running a construction company in the name of M/s Mukesh Gupta Construction Company and was earning Rs.1 lac per month. She claimed that she was entitled to Rs.40,000/- per month as maintenance as well as litigation expenses. After examining the issue, trial court came to the conclusion that petitioner would be liable to pay interim maintenance of Rs.7000/- per month. I am of the considered view that the order granting interim maintenance by the court below cannot be said on the higher side. Petition is without any merit and is hereby dismissed.
