The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.0029 dated 02.03.2019 at Police Station Rajasansi, District Amritsar Rural, under Sections 326/323/148/149 IPC.

At the time of issuance of notice of motion the following order was passed on 25.1.2021:
"The petitioner seeks grant of anticipatory bail in respect of a case registered vide FIR No.0029 dated 02.03.2019 at Police Station Rajasansi, District Amritsar Rural, under Sections 326/323/148/149 IPC.
Though the petitioner is attributed a blow with a Datar on the skull of the complainant, but it is a case where there is a crossversion, wherein the complainant Lakhwinder Singh is
- 2 - also alleged to have caused a blow from the reverse side of Datar, on the head of the accused Sarabjit Singh. Learned counsel for the petitioner has submitted that the matter in fact has been amicably resolved amongst the parties. Notice of motion for 06.04.2021.
Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 438(2) Cr.P.C."

Learned counsel for the petitioner has submitted that it is a case of cross-versions wherein the complainant Lakhwinder Singh is also alleged to have given a blow from the reverse side of 'datar' on the head of accused Sarabjit Singh. It has further been submitted that the matter stands amicably resolved amongst the parties with the intervention of respectables.

Learned State counsel, upon instructions from ASI Sukhdev Singh, has informed that pursuant to interim directions issued by this Court, the petitioner has since joined investigation and is not required for any custodial interrogation.

Having regard to the fact that it is a case where some person from the side of accused has also sustained injuries and the matter is also stated to have been compromised and while noticing that the petitioner has joined investigation, the petition is accepted and the interim directions issued by this Court vide order dated 25.1.2021 are hereby made absolute subject to the condition that the petitioner shall
- 3 - join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
