***** KARAMJIT SINGH , J. (Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.84 dated 27.6.2021 registered under Sections 392, 395, 427, 506, 148, 149 IPC at Police Station Sadar, Rajpura District Patiala.

The FIR in this case was registered on the basis of the statement of Shiv Kumar, as per which, he went to collect cash from the wine shop vendors in the area of Jansua in Bolero which was driven by Bhag Singh.

( 2 ) CRM-M-3142-2022 (O&M ) He collected `8,500/- from village Kotla and put the same in black bag and then left for village Jansua. At about 4 pm, his car was intercepted by 6/7 young boys armed with swords etc. The miscreants attacked the car of the complainant and damaged its wind shield and bonnet. The complainant and Bhag Singh raised alarm. In the meantime the police vehicle came there and the snatched bag was recovered from co-accused Manpreet Singh @ Moni while 4 other persons escaped on motorcycles. The petitioner was also apprehended at the spot.

The counsel for the petitioner contended that no incriminating article was recovered from the possession of the petitioner. The bag containing cash was recovered from possession of co-accused. The counsel further contended that the complainant and Bhag Singh driver have been examined in the trial Court. So there is no apprehension that if released on bail, the accused would pressurize or threaten the main prosecution witnesses.

The bail application is opposed by State counsel, who submitted that the petitioner was apprehended at the spot on 27.6.2021 and is also involved in another criminal cases.

Admittedly after completion of investigation, challan was presented and charges were framed against the petitioner and other accused persons. The complainant has been examined and other material witness Bhag Singh has also been examined-in-chief. The copies of the same are available on the record. It will take time for conclusion of the trial. So no purpose is going to be served in keeping the petitioner behind the bars. Thus

( 3 ) CRM-M-3142-2022 (O&M ) without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the CJM/Duty Magistrate concerned.
