Rajan Gupta, J (Oral) Challenge in the present revision is to order dated 17.10.2016 whereby cross examination of DW-Rajiv Chanana was treated as nil. It has been urged before the court that evidence of DW had commenced recently and counsel for the plaintiff was not able to cross examine him on 17.10.2016.

Learned counsel for the petitioner submits that one opportunity may be granted to cross examine DW at his risk and cost. In the interest of justice, plea is accepted. The trial court shall grant one opportunity to the petitioner to cross examine DW-Rajiv Chanana. It shall, however, be subject to payment of Rs.6000/- as costs to be remitted to respondent No.1. The trial court would conclude the proceedings expeditiously and in any case not later than two months. Petition is allowed in these terms.
