M.M.S.BEDI, J (Oral) Relying upon various interim orders passed by the trial Court, learned counsel for the petitioner submits that there is an apprehension that the suit for specific performance filed by the petitioner would be unnecessarily prolonged by the defendants-respondents.

I have heard learned counsel for the petitioner and gone through the interim orders reproduced in the revision petition. No doubt, the defendants-respondents have been able to prolong the proceedings by adopting the dilatory tactics but taking into consideration the stage of the trial i.e. the stage of recording of defendant's evidence, it is ordered that in case there is any delay or unreasonable adjournments, it will be open to the petitioner to request the trial Court for expeditious disposal of the case. In case, any such application is filed before the trial Court, it shall consider the same and make an endeavor to decide the suit expeditiously. Disposed of with the aforesaid observations.
