The instant petition has been filed challenging the complaint No. NACT 05 of 2023 dated 16.02.2023 titled as "Surjit Singh Vs. Harnek Singh" along with summoning order dated 11.11.2024 (Annexure P-2), having been passed by Judicial Magistrate Ist Class, Nihal Singh Wala under sections 138/142 of Negotiable Instruments Act, 1881.

Admittedly, the petitioner has not availed the remedy before the revisional Court/ Court of Sessions and therefore, the present petition is disposed of by observing that in case the revision petition is filed before the Sessions Court concerned, within a period of 02 weeks from today, the same would be decided on merits, without adhering the delay part, if any, within six months thereafter, in accordance with law.
