M/S Ramesh Chand And Sons v. Rajesh Kumar
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CR No. 3281 of 2017 Date of decision : 08.05.2017 M/s Ramesh Chand & sons ....Petitioner V/s Rajesh Kumar ....Respondent BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Sudhir Aggarwal, Advocate for the petitioner. RAJAN GUPTA J.
Present revision petition is directed against the order passed by trial court whereby application of the petitioner for leading additional evidence has been rejected. It has been urged before the court that it came to the knowledge of the petitioner-tenant that landlord owns another property in the area. Evidence qua same has to be led before the court below in order to rebut the plea of bona fide requirement. Admittedly, petitioner availed ample opportunity at the time he was to lead his evidence. However, he failed `to produce the evidence now sought to be produced. Trial court has, thus rejected the plea. It has also observed that property referred to in the application has been shown to be a residential in nature. I am of the considered view that no interference in revisional jurisdiction is called for. Dismissed.
Petitioner shall be at liberty to raise all the pleas at the stage of arguments.
