The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari for directing the official respondents to amend the counselling list dated 06.10.2023 and subsequent selection lists dated 13.10.2023 and 30.11.2023 against advertisement of respondent No.2 dated 17.12.2020 based on final result cum merit list dated 25.09.2023 for recruitment of 78 vacancies to the post of Naib Tehsildar.

Learned counsel would contend that the petitioner has secured 124 marks under the BC Category for women and in this category namely Harpreet Kaur has secured 157.50 marks while Rupinder Kaur has secured 151.50 marks, whereas the last selected candidate in General Category for women has secured 150 marks, therefore, the aforesaid two persons are required to be shifted to the open category, being more meritorious. In the eventuality of the aforesaid being done, the petitioner will be entitled to be considered against one of the posts of BC women category. In this regard, representations dated 09.11.2023, Annexures P-16 and P-17 have been submitted to the respondents, which has yet not evoked any response. However, he , at this stage, on instructions, submits that the petitioner is HAMANT 2024.02.20 11:41 I attest to the accuracy and authenticity of this order/judgment

CWP-1311-2024 sanguine of it being considered in a positive manner, in case, a direction is given to the respondents to decide the same in a time bound manner by granting him an opportunity of hearing.

At the asking of the Court, Mr. Gagneshwar Walia, Addl. A.G., Punjab accepts notice on behalf of the respondent-State and has no objection to the limited prayer made.

In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to the respondents to consider the representations dated 09.11.2023, Annexures P-16 and P-17 and decide the same within a period of three weeks and if found entitled, necessary benefit be granted to the petitioner forthwith.
