CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.
Whether Reporters of local papers may be allowed to see the judgment ?
2.
To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
The petitioner fancies that he has indefinite time for making available for getting witnesses to the Court and examine witnesses. It is a case where the petitioner had elicited in the cross-examination that RW-1 had secured an affidavit of his daughter and had it attested through the Oath Commissioner even when the daughter was in Australia. The attempt by the petitioner was, therefore, to show that the affidavit could not have been sworn to at the time in place which was indicated in the affidavit attested by the Oath Commissioner. The matter must end there. The attempt now by the petitioner is to show which other person could have actually impersonated. Such an enquiry is needless and wasteful attempt to overdo things. 2.
The trial Court found that the petitioner did not take effective steps to secure the presence of the witness and the document register from the Oath Commissioner. Even without such a reasoning, I PANKAJ KUMAR 2015.06.16 13:36 I attest to the accuracy and integrity of this document
C.R. No.3702 of 2015 (O&M) -2will not think it is necessary to secure the presence of the Oath Commissioner or the document in the manner in which the evidence has been produced by RW-1.
3.
I do not find any cause for interference. The revision petition is dismissed.
