Challenging the acquittal of the respondent for offence under Section 138 of the Negotiable Instruments Act, 1881, the complainant-petitioner had come up before this Court by filing the present appeal.

Vide order dated 10.09.2002, a Division Bench of this Court granted leave to appeal and admitted the matter.

The respondent is unrepresented.

Today, counsel for the appellant states that the appellant has not contacted him since long and even the communication sent to him has also not received back. Since he has no instructions, he wants to withdraw his power of attorney. 5.
Given above, the present appeal is dismissed for non-prosecution. However, the appellant shall be at liberty to file an application for revival of the appeal within three months from today. It is clarified that in case the appellant files any such application for revival of the appeal, he shall specifically mention the reason as to why he did not contact his counsel for such a long period. It is further clarified that the application for revival will be entertained only if the same is filed on or before 30.11.2023.
