For the reasons mentioned in the application, the same is allowed and legal heirs, as mentioned in para no. 2 of the application are ordered be impleaded as party, subject to all just exceptions and for the purpose of contesting this petition only.

Anuradha 2016.07.04 14:09 I attest to the accuracy and integrity of this document CM No.11728-CII-2016 in/and CR No.3722 of 2016 CR No.3722 of 2016 This petition has been filed against the concurrent orders dated 27.04.2015 and 07.04.2016 passed by the learned Courts below evicting the petitioner from the demised premises.

After arguing for some time, learned counsel for the petitioner, on instructions, states that the petitioner will not press this petition on merits and will vacate the premises voluntarily on or before 31.12.2016 without forcing the respondent to press execution petition and will continue to pay the monthly contractual rent in advance by the 7th of every month, and pay the other admissible charges regularly. He further undertakes to pay up to date of arrears of rent, if any, till 31.07.2016. Learned counsel for the respondent, on instructions, has also accepted this offer on the condition that the petitioner will file an undertaking to the above effect before the Executing Court till 31.07.2016 with the condition that in the event of any default, this petition should be deemed to be dismissed.

Learned counsel for the petitioner has accepted this condition. The revision petition is disposed of in the above terms. (AJAY TEWARI) June 02, 2016 JUDGE anuradha
