Learned State counsel refers to para Nos.6 to 8 of the reply dated 13/14.08.2025 filed by Chief Director, Vigilance Bureau, Punjab, SAS Nagar, which read thus:

" 6. That after conducting the enquiry in the complaint filed by the petitioner-Dharminder Singh, case FIR No. 4 dated 18-02-2025 under Section 7 of P.C. Act 1988, as amended by P.C. (Amendment) Act 2018 has been registered at Police Station Vigilance Bureau, Patiala Range, Patiala against respondent No. 5 (Head Warder Ramesh Chander No. 2502, Central Jail, Patiala). Copy of FIR is attached herewith as Annexure R-1. During the investigation of the above noted case, Head Warder Ramesh Chander No. 2502, Central Jail, Patiala was found to be involved in corruption. Hence, after conducting the investigation against him, prosecution sanction has been sought from the competent authority vide letter No. 8225/VB/Crime dated 29-07-2025. Chargesheet against accused Head Warder, Ramesh Chander has been submitted in the Ld. trial Court on 12.08.2025.

That during the course of the enquiry in the said complaint, it has come to light that Respondent No. 4-Gurjeet Singh Brar DSP Security, had joined Central Jail, Patiala on 02/09/2024 and thereafter upto 10/02/2025, a total of 81 cases have been got registered by the Respondent No.4 at Police Station Tripuri, Patiala against the prisoners/under trials detained in Central Jail, Patiala, after checking different MOHIT 2026.04.07 17:54 I attest to the accuracy and integrity of this document

CRM-M-3004-2025 (O&M) -2Wards/Barracks regarding smuggling of prohibited items like, mobile phones, etc. Therefore, said DSP Gurjit Singh (Respondent No.4) has infact taken action aganst the prisoners for smuggling of the prohibited items in the jail. It is also pertinent to mention here that Head Warder Ramesh Chander (Respondent No.5) was suspended vide order No.9635-10 dated 18-09-2024 by the Superintendent, Central Jail, Patiala on the basis of recommendation made by the Respondent No.4 in his preliminary enquiry on recovery of 12 packets of Tabacoo from him. Therefore, no connivance between Respondent No. 4 and Respondent No. 5 came to light during enquiry.

That it is further submitted that on 17/12/2024, a cell in the Jail called Chakki No. 88 was searched by the Respondent No.4-Gurjit Singh Brar DSP Central Jail, Patiala while performing his duties. A mobile phone was recovered during search from prisoners Sohan Singh, Kunal Rao and Taranpreet Singh. It is pertinent to mention here that the prisoner Sohan Singh is relative of the petitioner-Dharminder Singh. Therefore. on the very next day, on 18/12/2024, the petitioner/complainant Dharminder Singh, a relative of Sohan Singh prisoner, made a complaint (Annexure P-4) addressed to A.D.G.P., Vigilance Bureau, Punjab, Chandigarh and similar complaint (Annexure P-5) was addressed to the Director General of Police, Punjab, Chandigarh to put pressure upon the Respondent No.4-DSP Gurjit Singh Brar.

During the course of enquiry in the said complaint, no evidence came on record against respondent no.4, whereas evidence regarding receiving bribe money by Respondent No. 5 (Head Warder Ramesh Chander) came to light on the basis of video supplied by the petitioner. Consequently. above-mentioned case was registered against Head Warder Ramesh Chander only."

In view of the above, no further orders are required to be passed. 3.
