The grievance of the petitioner is that the plaintiff's side has been closed without affording adequate opportunity. The order passed is set aside, dispensing with notice to the respondents on condition that the plaintiff pays costs of `5000/- to the defendants within a period of two weeks from the date of receipt of copy of this order, failing which the order already passed will stand.
