Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in a criminal complaint No. 68/2017 dated 03.03.2017 titled as "Amit Kumar v. Lakhwinder Singh" under Sections 138 & 142 of the Negotiable Instruments Act, 1881 (hereinafter referred to as "the Act") read with Section 420 IPC.

Learned counsel for the petitioner contended that petitioner was earlier admitted to bail in case under Section 138 & 142 of the Act read with Section 420 IPC and his bail was cancelled vide order dated 12.09.2018 as he failed to put in appearance on a single date because of the reason that wrong date was communicated to him by his counsel. However, petitioner is ready to appear before the learned trial Court regularly and also to furnish fresh bail bonds.

Criminal Misc. No. M-4795 of 2019 On asking of the Court, Mr. Ajay Pal Singh Gill,. Deputy Advocate General, Punjab accepts notice on behalf of respondent(s) No. 1. A copy of paper-book be provided to him during the course of the day. In view of the fact that petitioner was earlier admitted to bail; he was appearing regularly before the learned trial Court and trial of the case is at the final stage, the learned trial Judge shall release him on fresh bail, in case petitioner surrenders before him and moves an application for grant of fresh bail, on his furnishing fresh bail bonds and two sureties to the satisfaction of the learned trial Court. The learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
