RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of necessary directions to official respondents No.1 and 2 to take appropriate departmental action against respondents No.10 and 11, who have been held guilty by respondent No.3 for committing embezzelment/misappropriation of Rs.88,80,912/- i.e. Rs.65,24,800/- in auction amount of Panchayat land and Rs.23,56,112/- Annexure P-5, grants issued by department under different scheme. It is also prayed to recover the amount from respondents No.10 and 11, which is public money, as per inquiry report, Annexure P-5, of respondent No.3. It is further prayed to direct respondents No.1 and 2 to pass speaking orders upon the inquires reports, dated 09.08.2023 and 29.09.2023, Annexures P-4 and P-5, sent to him by respondents No.

3 and 5 for taking further action against respondents No.10 and 11, in accordance with law. It is also prayed to direct respondents No.1, 2 and 4 to decide the representation, dated 15.12.2023, Annexure P-6, and to take necessary action on the inquires report and representation, dated 01.10.2023, Annexure MEENU 2024.01.

It has been submitted by learned counsel for the petitioner that despite there being finding of embezzlement against respondents No.10 and 11, no action has been taken by the respondents/authorities till date. Notice of motion to official respondents only at this stage. On asking of the Court, Ms.Akshita Chauhan, DAG, Punjab, who is present in Court, accepts notice on behalf of the respondents/State and submits that the representation is already under consideration before respondent No.2 and the proceedings would be completed expeditiously. Heard.

In view of the statement made by learned State counsel, the present petition is disposed of with a direction to respondent No.2, i.e. Director, Department of Rural Development and Panchayats, SAS Nagar, to complete the proceedings pending before it expeditiously in accordance with law preferably within three months from today.
