(ORAL) Through instant petition under Article 227 of the Constitution of India, challenge has been laid to order dated 03.05.2018 (Annexure P-3) of the trial Court, Batala, whereby application of the petitioner for extension of time for payment of 50% of the bill amount, was dismissed. Learned counsel for the petitioner inter alia contends that the trial Court refused to accept 50% bill amount being not deposited within time prescribed by it. The petitioner would suffer irreparable loss, in case, time for deposit of 50% bill amount, granted by the trial Court, is not extended.
Having heard learned counsel for the petitioner, without commenting on the merits of the case, in the interest of justice, impugned order is set aside. Petitioner is directed to deposit 50% of the bill amount latest by 25.05.2018. The trial Court shall accept the same, in case, it is deposited by 25.05.2018.
