The revision petitioner is aggrieved that he was allowed to join the proceedings only from the date of passing of the order. He would state that he holds an agreement of sale from the vendor which is earlier in point of time to the plaintiff's agreement and he has himself filed a suit for specific performance. Right of cross-examination of the plaintiff must be allowed to be continued at least from the date of filing of the application for setting aside the order. I will accord to him such an order and impose costs of ` 5,000/- for recalling of any witness who had given evidence in part or who had not given evidence at all before the date of filing of application for setting aside the ex parte order. Any evidence which had been closed before the filing of application of the applicant will not be entertained.

I dispense with notice to the respondents and dispose of the civil revision with the above observations.
