The petitioner incarcerated in the FIR captioned above, has come up before this Court under Section 483 BNSS 2023 for grant of bail in the FIR captioned above on the ground of his sister's marriage.

During the pendency of the main petition CRM-11998-2025 was filed by petitioner for grant of interim bail. Counsel for the petitioner submits that the parents of the petitioner are not able to make proper arrangements due to old age for the marriage of his sister, which is scheduled for 13.04.2025 and 14.04.2025, therefore he seeks 15 days interim bail. 3.

Counsel for the State on instructions does not dispute the contention made by counsel for the petitioner.

On the consent of both the parties, main case is taken up on board. 5.

In the Indian Society, role of a brother is special to make arrangements of wedding, customs require presence of brother on each and every step and time is required to make preparations before wedding and even after the wedding. Thus in the entirety of facts and circumstances of the case, petitioner is entitled to interim bail. 6.

Given above, provided the petitioner is not required in any other case, the petitioner shall be released on interim bail in the FIR captioned above subject to furnishing bonds to the satisfaction of the concerned Court and due to unavailability before any nearest Ilaqa Magistrate/duty Magistrate. Before accepting the surety, the concerned Court must be satisfied that if the accused fails to appear, such surety can produce the accused.
