There is no prima face case for intervention in the revision petition. The plaintiff has come through a challenge to an order passed by the District Commissioner informing the petitioner of the fact that the application for registration as hotel was being rejected and that he would be liable to prosecution for allowing illegal stay in the hotel. It will be open for the plaintiff to take such objection as regards the correctness of the prosecution and its tenability at the time when such prosecution is launched. There is no prima face case for Civil Court to grant any interim relief in favaour of the plaintiff. I make no intervention but the petitioner will have any independent right which he may canvass for challenging the correctness of the order but not with an interim application in the pending suit.

The revision petition is dismissed.
