To be referred to the Reporters or not ?

3.

Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.

The revision petition is against the order allowing the matter to be taken away from the Court of Ms. Gurmeet Kaur, Additional District Judge, Jallandhar where the appeal was being heard. The Judge declined to take the case further when a representation was made by a party that a transfer application had been moved before the District Judge. The petitioner is here to contend that no transfer application had been made and the party was making a wrong representation that had allowed the Judge to refer the matter back to the District Judge. Even if there had been a wrong representation, there was no reason for a particular District Judge to feel aggrieved that there was an application for transfer moved to consider sending it back to the District Court for transfer. If that was the decision taken by the Court, it must be left at that. I do not think it is going to be a matter for reappraisal by this Court.
