By this petition, the petitioner seeks the concession of anticipatory bail, upon FIR no.335, dated 25.11.2020, having been registered at Police Station Kamboj, District Amritsar Rural, alleging therein the commission of offences punishable under Sections 452/324/323/427/148/149 of the IPC (with Section 326 of the IPC having been added later).

Learned counsel for the petitioner today submits that the entire story has been concocted by the complainant on account of the fact that the son of the complainant had married the daughter of Major Singh, with the entire family and relatives of Major Singh therefore roped in, the petitioner also having been so roped in.

He submits that the fact that others were unnecessarily roped in would be obvious from the fact that it has been noticed in the order passed by the learned Additional Sessions Judge, Amritsar, while admitting a coaccused, Manjit Singh, to bail, that Manjit Singh was in fact found to be on PRAVEEN KUMAR 2021.09.28 12:17 I attest to the accuracy and integrity of this document

CRM-M-3734 of 2021 duty as a Security Guard at the time that the occurrence took place. Even having considered that contention, what cannot be ignored by this court for the purpose of this petition, is that the allegation against the petitioner is that he, armed with a datar, caused injuries on the person of the complainant on her legs, with injuries 3 and 4 shown as per the MLR dated 21.11.2020 (reproduced in paragraph 4 of the reply), seen to be commensurate with that allegation.

It is also to be noticed that counsel for the petitioner on earlier dates had submitted that there is no explanation for the delay in lodging the FIR but with it again stated by the DSP in his affidavit (as noticed in earlier orders), that the victim first went to the nearby private hospital (Preet Hospital), after which she had gone to the Guru Angad Dev Hospital. The medical report issued by the Preet Hospital has also been annexed as Annexure R-3 with the reply of the DSP, showing that the patient Jasbir Kaur (complainant), had arrived at that hospital at 1.30 am on 16.11.2020 (with the occurrence shown to be at 10.30 pm on 15.11.2020 in the FIR).

Keeping in view the above, without making any comment on the actual merits of the case, I find no ground to entertain this petition any further, which is consequently dismissed.
