The issue of limitation could not have been taken up as a preliminary issue after the plaintiff's side was over and the case was posted for the defendant's side. The Court was justified in saying that the issue will not be taken up after the trial has commenced and need not be taken up as preliminary issue. The decision taken by the court below is correct and there is no scope for intervention.
