Present petition under Article 227 of the Constitution of India for setting aside order dated 19.4.2016, passed by learned Civil Judge (Senior Division), Faridabad, whereby the evidence of petitioner was closed by the Court order as petitioner failed to make payment of costs imposed by this Court on 3.2.2016 and also failed to lead evidence. Learned counsel for the petitioner submitted that on the date fixed i.e. 18.4.2016, petitioner was ready to make payment of costs and the witnesses were also present.
This plea of petitioner is contrary to the record. More so, petitioner was given relief to lead additional evidence and at that stage, DEEPAK KUMAR BHARDWAJ 2016.06.03 12:07 I attest to the accuracy and integrity of this document
Civil Revision No. 3933 of 2016 petitioner should have been very cautious to avail the said relief having been granted by this Court. But the petitioner failed to lead the evidence and even failed to make the payment of costs for the reasons best known to it. It is settled proposition of law that judicial proceedings shall be presumed to have been carried out in accordance with law, unless there is anything contrary to that. But at this stage, there is nothing before this Court to say so. Consequently, present petition is without any merit and the same is hereby dismissed.
