Rajan Gupta, J (Oral) Present revision is directed against the order passed by the trial court whereby evidence of the petitioner has been closed by order. It has been urged before the court that plaintiff filed his affidavit as examination-in-chief. Thereafter, he could not appear before the court due to his medical condition. Learned counsel submits that in case one opportunity is granted, evidence of the plaintiff would be concluded. Keeping in view the facts and circumstances of the case, this court feels that one opportunity needs to be granted to the petitioner to conclude his evidence. Impugned order is hereby set-aside. Trial court would grant one opportunity to the petitioner to conclude his evidence. This court is conscious of the fact that matter is disposed of without issuing notice to the respondent. Thus, petitioner would be liable to pay Rs.5000/- as costs which may be remitted to the contesting defendants. Revision petition is allowed in these terms.
