Anupinder Singh Grewal, J (Oral) The petitioner is seeking regular bail in FIR No.280 dated 3.8.2015 under Sections 302, 307, 323, 324, 325, 326, 450, 452, 148, 149 and 120-B IPC registered at Police Station, A - Division, District Amritsar. Learned counsel for the petitioner contends that the petitioner is not named in the FIR and the allegations therein are that deceased was attacked by some unidentified persons. He also contends that all the material prosecution witnesses including injured Baghicha Singh (PW-4) have not supported the prosecution case regarding culpability of the petitioner. The petitioner is in custody since 10.8.2015 and completion of AVIN KUMAR 2019.04.04 09:58 I attest to the accuracy and integrity of this document

CRM No.M-3892 of 2019 [2] trial is likely to take some time. The petitioner is not involved in any other case.

Learned State counsel, on instructions from ASI Kuldeep Singh, does not dispute the submissions made by the learned counsel for the petitioner with regard to material prosecution witnesses having turned hostile. She submits that 10 witnesses out of 34 have been examined. In view of the submissions of the learned counsel for the petitioner, especially when petitioner is in custody for over 2 1⁄2 years; he is not involved in any other case; and the conclusion of trial is likely to take some time, I deem it appropriate to grant the petitioner concession of regular bail.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner, namely, Rakesh Sondhi @ Sunny is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/ Duty Magistrate.
