RAMENDRA JAIN, J. (ORAL) Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Gurpreet Singh in a case arising from FIR No.246 dated 28.08.2018 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Phillaur, District Jalandhar Rural, Jalandhar. According to the prosecution, 52 vials of Avil 10 ml and 52 injections of OMGECIE (Bupronorphine I.P.-2ml) were recovered from the conscious possession of petitioner and his two accomplice, without any permit or licence.

Learned counsel inter alia contends that petitioner is in custody since 28.08.2018. Conclusion of trial may take a sufficient long time. Coaccused of the petitioner, namely, Karan Kumar, has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 03.12.2019 RAVINDER SINGH 2020.01.31 14:08 I attest to the accuracy and integrity of this document

-2CRM-M-2983 of 2020 passed in CRM-M-17808 of 2019. No useful purpose would be served by detaining the petitioner in jail any more. Treating the case of the petitioner on same parity as that of his co-accused, he may also be granted regular bail.

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Treating the case of the petitioner on the same parity as that of his aforesaid co-accused, he (Gurpreet Singh) is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
