(ORAL) Present appeal has been preferred by appellants-defendants being aggrieved by judgment and decree dated 08.01.2003 passed by learned Additional District Judge, Bathinda, whereby first appeal preferred by respondent-plaintiff was allowed and judgment and decree dated 21.11.2000 passed by learned Additional Civil Judge (Senior Division) Bathinda, dismissing the suit for declaration, possession and permanent injunction preferred by respondent-plaintiff, was set aside. 2.
It is asserted that during the pendency of present appeal, the parties have settled all their disputes with the intervention of Panchayat and have entered into a compromise dated 15.12.2025 in presence of witnesses. Copy of compromise has been duly annexed as Annexure A-1 along with affidavit of respondent-plaintiff, wherein he has admitted having entered into SUNIL CHANDER 2026.05.25 16:17 I attest to the accuracy and integrity of this document
RSA No.2331 of 2003 (O&M) -2a compromise with the appellants-defendants. As per compromise sale deeds No.4380, 4381 and 4382 dated 30.03.1995 and sale deed No.1049 dated 01.06.1995 executed in favour of Janta Singh @ Gurjant Singh, Balwinder Singh @ Baljinder Singh, Ajaib Singh son of Banta Singh son of Lal Singh were accepted to have been executed by respondent-plaintiff and respondent-plaintiff has agreed that he will not raise any objection to said sale deeds. It was agreed that RSA No.2331 of 2003 and RSA No.2332 of 2003 may be allowed in view of compromise.

In view of compromise, present applications (CM No.42-C of 2026) for disposing the present appeal in view of settlement dated 15.12.2025 (Annexure A-1) as well as present regular second appeal are allowed. Impugned judgment dated 08.01.2003 is set aside and judgment and decree dated 21.11.2000 passed by learned Court of First Instance is restored back whereby suit preferred by respondent-plaintiff challenging the sale deeds was dismissed. Parties shall remain bound by the terms of compromise.
