-.- AMIT RAWAL J. (ORAL) Concededly the order under challenge dated 09.04.2018 reveals that the application filed by the respondents-defendants for setting aside the ex parte order dated 17.12.2015 for disbursement of compensation awarded in view of acquisition of land, had been allowed by imposing costs of `25,000/-.

Learned counsel for the petitioner submitted that the application was wholly vexatious and belated by a period of one year but when this Court raised a specific query whether costs of `25,000/- has been paid, counsel for the petitioner acknowledged receipt of the same.

Acceptance of costs of `25,000/- tantamounts to acquiescence to the order under challenge and estoppel to lay challenge to the same. The prayer for refund of costs at this stage cannot be accepted.
