(ORAL) Vide impugned order dated 2.5.2018, passed by learned Civil Judge (Junior Division), Gurugram, defendant No. 2 was allowed to place on file copies of some orders mentioned in impugned order by way of additional evidence.
The learned counsel for petitioner contends that these documents were not pleaded and cannot be relied upon. If it is so, petitioner can always raise this contention at the time of final arguments that these documents were not pleaded and could not be relied upon.
Considering that case is fixed for rebuttal and arguments, trial Court is directed to decide the case within three months from the date of receipt of certified copy of this order, excluding summer vacations. Liberty is also granted to raise all available pleas before trial Court. At this stage, learned counsel for petitioner seeks to withdraw present revision.
Dismissed as withdrawn.
