***** RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner in a case arising from FIR No. 222 dated 19.12.2018, registered under Sections 21/22 of the NDPS Act, 1985, Police Station Adampur, District Jalandhar. According to the prosecution, on 19.12.2018, petitioner was nabbed in the area of Alwarpur, Adampur by the police Party headed by SI Gurpreet Singh on the basis of suspicion. He threw a plastic envelope in the car after taking it out from the right pocket of his pant. On search of the said envelope, two more envelopes were recovered, out of which one was found containing 05 gram heroin and another containing 50 grams of intoxicant powder.

Learned counsel for the petitioner inter alia contends that SONIKA 2019.01.25 10:34 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-2178-2019 --2-- FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery, which falls under 'non-commercial' was a narcotic substance. Petitioner is in custody since 20.12.2018. In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to his furnishing personal bonds and two sureties of `2.00 lakh each to the satisfaction of the trial Court/Duty Magistrate, concerned only till receipt of the FSL report.

The petition stands disposed of accordingly.
