At the outset, learned counsel for respondent-landlord submits that the petitioner has not vacated the demised premises, in terms of undertaking dated 28.05.2018 to vacate the premises within one year, thereby forcing the respondent to file execution petition. In view of the above, the instant revision is dismissed for non-compliance of aforesaid undertaking qua vacation of the demised property by the petitioner, in utter violation of order of this Court, which amounts to contempt of this Court.
The Executing Court is directed to recover the arrears of rent held by the learned learned Rent Controller/Appellate Authority, besides mesne profits @ `50,000/- per month w.e.f. 29.05.2019, till vacation of the shop in question by adopting all means including coercive methods against the petitioner. Respondent-landlord is also at liberty to file contempt petition against the petitioner.
