Present:

CORAM:HON'BLE MR. JUSTICE K. KANNAN 1.
Whether Reporters of local papers may be allowed to see the judgment ?
2.
To be referred to the Reporters or not ?
3.
Whether the judgment should be reported in the Digest? -.- K. KANNAN J. (ORAL) 1.
There is no intervention possible in a situation where in a second appeal brought before this Court, the interim order has been vacated. The Executing Court is bound to execute it in the manner it is there and if any modification of the order passed by this Court in the second appeal is necessary on the plea of any equity in his favour, the same shall be done in the second appeal and not by means of civil revision before this Court. The revision petition is incompetent in such a situation and I find no error in the order passed by the Court below in allowing for further process in execution to go, taking note of the fact that the stay has already been vacated.
2.
The revision petition is dismissed.
