The petitioner (Sonu Sharma) instituted an application, appended with the petition, as Annexure P-1, before the Superintendent of Jail, District Prison, Yamunanagar, wherethrough, he applied for the grant of facility of parole.

However, without the apposite application being decided by the competent authority concerned, the petitioner has moved this Court, for his being granted the facility of parole.

Consequently, the extant petition becomes premature, and, also is not well constituted. Therefore, at this stage, the petition is permitted to be dismissed as withdrawn.

The Superintendent of Jail concerned, is directed to, forthwith, forward the afore application (P-1) to the competent authority concerned, and, the latter shall, within four weeks hereafter, after considering the same, pass a speaking order thereon, in accordance with law. It is needless to emphasize, that in case thereon(s), a decision adverse to the petitioner becomes recorded by the competent authority, thereupon, it is open to the petitioner to recourse all the available remedies, in accordance with law.
