PANKAJ JAIN, J. (ORAL) This is second petition filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.5 7, dated 15th of July, 2021 registered for the offences punishable under Sections 21 and 29 of the NDPS Act, at Police Station Fatehgarh Churian, District Batala. Counsel for the petitioner submits that the challan already stands filed and the petitioner is in custody since 24th of May, 2022. He is not in position to dispute the fact that a huge quantity of contraband amounting to 1020 tablets was recovered from the petitioner and as per the FSL report the same has been found to be Tramadol. In view of the recovery effected from the petitioner the case of the petitioner for regular bail would be hit by rigors as contained in Section 37 of the NDPS Act.

Resultantly, this Court finds that the relief as prayed for cannot be granted in view of Section 37 of the NDPS Act. Consequently, the present petition is dismissed.
