IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CR-4180-2015 (O&M) Date of Decision :22.3.2018 Vinod Thapar and another ....Petitioners vs.

Seema Mehra and others ....Respondents CORAM : HON'BLE MR. JUSTICE AJAY TEWARI

Present:

Mr.Sunil Chadha, Senior Advocate with Ms. Arti Kaur, Advocate for the petitioners.

Mr. Akshay Bhan, Senior Advocate with Mr. Santosh Sharma, Advocate for the respondents.

**** AJAY TEWARI, J. (Oral) It has been pointed out that in order dated 20.3.2018 it has been wrongly mentioned that counsel for the petitioner had stated that there is urgency in the matter whereas it was counsel for the respondent who has stated so.

This revision has been filed against the concurrent orders of the Courts below allowing ejectment of the petitioner-tenant from the demised premises.

After arguing form some time the matter has been settled with the intervention of the learned Senior Counsel. Today on instructions from his client the learned counsel for the petitioners has stated that the petitioners will not press this petition on merits and will vacate the premises Anuradha 2018.03.26 15:24 I attest to the accuracy and integrity of this document

CR-4180-2015 (O&M) voluntarily on or before 31.03.2019 without forcing the respondents to file/pressing an execution petition. In consideration for that the respondents agreed to waive off whatever amounts may be due to them on account of rent/mesne profit and further agreed that the petitioners would not be liable to pay any money up till 31.3.2019 subject to the condition that the petitioners will file an undertaking to the above effect before the Executing Court/Trial Court on or before 30.4.2018, failing which, this revision should be deemed to be dismissed.

Learned counsel for the petitioners has accepted this condition. In the circumstances, the revision petition is disposed of in the above terms.

Since the main case has been decided, the pending civil miscellaneous application, if any, also stands disposed of. (AJAY TEWARI) 22.3.2018 JUDGE anuradha Whether speaking/reasoned - Yes/No Whether reportable - Yes/No Anuradha 2018.03.26 15:24 I attest to the accuracy and integrity of this document
