RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner - Kuldeep @ Ratha in a case arising from FIR No.23 dated 02.02.2019 registered under Sections 323, 341, 325, 394, 307, 201, 506, 34 IPC and Section 25 of the Arms Act, 1959 at Police Station Sadar Tohana, District Fatehabad. Learned counsel for the petitioner, drawing attention of this Court towards statements of complainant Roop @ Ram Roop PW2 (Annexure P-2) and Geju Ram PW3 (Annexure P-3), who got admitted injured PW2 to hospital inter alia contends that material witnesses have turned hostile. Petitioner is in custody since 11.04.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more.

On the other hand, learned State counsel vehemently opposed RAVINDER SINGH 2020.01.28 16:50 I attest to the accuracy and integrity of this document

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner - Kuldeep @ Ratha is ordered to be released on bail during pendency of trial, if not required in any other case, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
