The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the official respondents to take appropriate legal action against the Patwari for submitting a false and fabricated 'Action Taken Report' and extending threats to the petitioner as also directing the official respondents to take appropriate legal action against the private respondents for digging up the legally recorded passage to the fields of the petitioner. Learned counsel for the petitioner contends that on 10.09.2000 the private respondents, in connivance with Patwari Mahabir, dug up the legally recorded passage to the fields of the petitioner by ploughing a tractor. The petitioner had submitted applications in this regard on the CM Window on 14.09.2020 and again on 10.12.

2020, but no action was taken on the said applications. Thereafter, the petitioner moved another application to the Chief Minister, Haryana; Deputy Commissioner, Bhiwani and Tehsildar, Bawani Khera for taking action against the private PARKASH CHAND 2021.01.

CWP No.2055 of 2021 -2respondents. Copies of the said applications/representations have been appended as Annexures P-2 to P-4. Learned counsel for the petitioner has further contended that he would be satisfied if the representation dated 22.12.2020 (Annexure P-3) addressed to the Deputy Commissioner, Bhiwani is decided in accordance with law in a time-bound manner. Notice of motion.

On the asking of the Court, Mr. Rajesh Gaur, Addl. A.G., Haryana has joined the session through video conferencing and accepts notice on behalf of respondent Nos.1 to 4. Since the matter is not being decided on merits, service on other respondents is dispensed with. Heard learned counsel for the parties.

In view of the limited prayer made by learned counsel for the petitioner, without expressing any opinion on the merits of the case, the present petition is disposed off with a direction to respondent No.2 to decide the representation dated 22.12.2020 (Annexure P-3) in accordance with law as expeditiously as possible, preferably, within a period of one month from the date of receipt of certified copy of this order. Disposed off accordingly.
