(The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual Court). **** RAVI SHANKER JHA, CHIEF JUSTICE ( Oral ) This is an application under Section 11 (6) of the Arbitration and Conciliation Act, 1996 filed by the applicant seeking appointment of an Arbitrator pursuant to clause 16.2 of the agreement entered into between the parties on 14.03.2013.

It is submitted that a dispute has arisen between the parties which needs to be decided by an Arbitrator and for that purpose an Arbitrator be appointed. Both the parties have furnished the necessary declaration under Section 12 of the Arbitration and Conciliation Act, 1996, received from Justice Mukul Mudgal (Retired Chief Justice) and have also submitted that they have no objection and are willing to get the arbitration proceedings conducted by the said Arbitrator.
