(ORAL) The petitioner challenges the impugned order dated 17.03.2016 whereby the prayer for seeking demarcation of the property has been dismissed. The suit was filed on 21.12.2013 and the application was submitted to the revenue authorities on 28.02.2013 for carrying out the demarcation and the report dated 11.04.2013 was submitted giving details of demarcation.
In a suit for injunction, the petitioner cannot seek indulgence of the Court to collect evidence when he has not pleaded so in the plaint. Even the petitioner could not succeed in the interim application. I do not think any ground is made out for interference in the revision petition. The order passed by the trial Court cannot be said to be without jurisdiction. The revision petition is dismissed.
